These Terms and Conditions ("Terms") constitute a legally binding agreement between you (“User”) and SiteSmart Pvt Ltd (“SiteSmart,” “we,” “our,” or “us”) governing your use of our services, software, website, and mobile applications (collectively, the “Platform”). By accessing or using any part of the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of the Terms, you may not access the Platform or use our Services.
Your use of the Platform is also governed by our Privacy Policy and Refund & Cancellation Policy, which are hereby incorporated by reference into these Terms.
In these Terms: (i) "User" refers to any individual or legal entity accessing or using the Platform; (ii) "Services" refer to all functionality made available by SiteSmart, including but not limited to construction project planning, procurement tools, scheduling, professional service listings, inspection reports, and digital documentation tools; (iii) “Content” refers to any data, text, images, video, documentation, or materials uploaded or transmitted by Users or displayed on the Platform.
SiteSmart provides a digital infrastructure platform tailored for the construction industry, designed to streamline project workflows across planning, execution, procurement, inspections, and collaboration. Services include but are not limited to: (i) task and timeline management for construction teams; (ii) uploading and sharing of daily work updates, invoices, and documents; (iii) access to a marketplace for construction materials through third-party sellers; (iv) booking and coordination with professional service providers such as architects, surveyors, and engineers; and (v) inspection tracking and report management. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without liability.
Users are responsible for ensuring that all information provided during account registration and usage of the Platform is truthful, complete, and kept up-to-date. You are expected to use the Platform in compliance with all applicable local, state, national, and international laws. Any unauthorized use of the Platform, including data scraping, distribution of malicious code, impersonation, harassment, or uploading illegal or offensive material, will result in account suspension or termination and may involve legal proceedings.
To access full functionality of the Platform, Users must create an account using a valid email address and mobile number. Upon registration, you must choose a secure password and agree to keep this information confidential. You are solely responsible for activities that occur under your account. We reserve the right to refuse registration, cancel accounts, or block access at our discretion.
Certain features of the Platform are available on a subscription or pay-per-use basis. Payment obligations are binding once a subscription is activated. Payments are securely processed through third-party payment gateways such as Razorpay. All charges are exclusive of applicable taxes, which will be levied as per statutory regulations. We do not store any card or payment details. Refunds or cancellations are subject to our Refund & Cancellation Policy and are generally not permitted unless explicitly specified.
By uploading or submitting any Content to the Platform, you grant SiteSmart a non-exclusive, royalty-free, worldwide license to host, use, reproduce, modify, and display such Content as necessary for providing the Services. You affirm that you have all rights and permissions to share such Content and that it does not infringe upon the intellectual property or privacy rights of any third party. Content that violates applicable law or our content policy may be removed without notice. We reserve the right, but are not obligated, to review, monitor, or remove any Content at our sole discretion.
Users are expressly prohibited from using the Platform to engage in any activity that is illegal, harmful, defamatory, obscene, infringing, harassing, or otherwise objectionable. Prohibited actions include but are not limited to reverse-engineering the software, attempting unauthorized access to SiteSmart’s systems or data, distributing malware or spam, or impersonating another user or company. Violations may lead to permanent termination of your access and may be reported to appropriate authorities.
All content, logos, software, source code, designs, documentation, databases, and trademarks used or displayed on the Platform are the exclusive intellectual property of SiteSmart or its licensors and are protected under applicable Indian and international intellectual property laws. This includes the structure, look and feel, interface, and the functionality of the Platform.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your internal business purposes only. You may not reproduce, distribute, create derivative works from, publicly display, or exploit any part of the Platform without express prior written permission from SiteSmart.
Unauthorized use of any SiteSmart intellectual property may result in legal action, including injunctions, civil claims, and criminal prosecution under applicable law. You agree not to reverse-engineer, decompile, or otherwise attempt to extract the source code of the Platform or its components, or use the Platform for creating a competing product or service.
SiteSmart also reserves the right to take technical or legal action, including disabling access or pursuing civil remedies, against those who attempt to copy, mirror, or replicate any aspect of the SiteSmart platform, brand, or service offering.. No portion of the Platform may be copied, reproduced, modified, republished, or distributed without prior written consent from SiteSmart. Unauthorized use may result in civil or criminal penalties.
The Platform may contain links to or integrations with third-party websites and services, including but not limited to payment gateways (e.g., Razorpay), logistics service providers, customer support tools, analytics platforms (e.g., Google Analytics), and CRM tools. These services are provided solely for your convenience and to enable key functionalities of our Platform such as payments, deliveries, and performance monitoring.
SiteSmart does not control these third-party services and assumes no responsibility for their availability, content, data practices, privacy policies, or performance. When you interact with these external services— for example, by completing a payment or clicking a link—you do so at your own risk and are bound by the terms, conditions, and privacy policies of those respective services.
We recommend that you carefully review the terms and privacy notices of any third-party platforms you access through our Platform. Your continued use of SiteSmart indicates your agreement that SiteSmart is not liable for any loss or damage arising from your reliance on or interaction with third-party platforms, even if such platforms are integrated or featured within our Services.
We may suspend or terminate your access to the Platform, without notice or liability, if you breach these Terms, engage in unlawful activities, or if your continued use threatens the integrity or security of our systems. Termination does not affect any payment obligations or rights that accrued prior to termination. Upon termination, your access to your account and any associated data may be permanently deleted.
We also reserve the right to terminate inactive accounts after a period of twelve (12) months of non-use, with prior notice to the registered email address.
SiteSmart provides the Platform and Services on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the accuracy, reliability, or suitability of the Services for your purposes. We disclaim all warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
While we use industry-standard security measures and strive to protect all data uploaded or shared through the Platform, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or misuse your personal data. By using our Services, you acknowledge that there are inherent security risks associated with transmitting data over the internet and that SiteSmart shall not be held liable for any accidental or unlawful loss, access, misuse, or disclosure of data resulting from such risks, except as required under applicable laws.
You assume full responsibility and risk of loss resulting from your use of the Platform. and “as available” basis. We make no warranties, express or implied, regarding the accuracy, reliability, or suitability of the Services for your purposes. We disclaim all warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. You assume full responsibility and risk of loss resulting from your use of the Platform.
To the maximum extent permitted under law, SiteSmart shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, goodwill, or business interruption. Our liability is limited to the total fees paid by you to us for the Services in the three (3) months preceding the event giving rise to the claim. This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.
You agree to indemnify, defend, and hold harmless SiteSmart, its directors, employees, contractors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt
(including attorney’s fees) arising from (i) your use of or access to the Platform, (ii) your violation of these Terms, or (iii) your violation of any third-party rights, including intellectual property or privacy rights.
SiteSmart shall not be held liable for any delay or failure in performance of its obligations under these Terms if such delay or failure arises from events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, pandemic or epidemic, power failures, internet outages, or actions of governmental authorities.
These Terms are governed by and shall be construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.
In accordance with the Information Technology Act, 2000 and related rules, SiteSmart has appointed a Grievance Officer to address user concerns and complaints relating to the Platform or Services. If you have any grievances, you may contact:

We may revise or update these Terms from time to time. Material changes will be communicated via prominent notices on the Platform or email. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of the changes.
